2262 - Canary Islands Health Service . - Notice by making public the decision of March 14, 2007, the Director, rejecting the request for authorization to transfer operation of the medical consultation (U. 46 Plastic Surgery Reconstructive), located at Avenida Assumption, 30, 2nd left, in the municipality of Santa Cruz de Tenerife, whose owner is D. Cristino Suárez López de Vergara. Regard to the proposal of the Head of Accreditation Services of the Directorate on the medical consultation (U. 46 Plastic and Reconstructive Surgery) (health care providers without imprisonment), located at Avenida Assumption, 30, 2nd left, the municipality Santa Cruz de Tenerife, owned by D. Cristino Suárez López de Vergara in the following that are relevant. 1 . - The query operation had granted authorization by Resolution of the Directorate of Health Canario No. 140/TF of February 29, 2000, for the location of Rambla Pulido, 32, 2 of the municipality of Santa Cruz de Tenerife. It is registered in the Register of Centres, Services, Health Facilities and Activities with number 1202. However, it had no operating license to travel. 2 . - Operating Permit Request to transfer to Assumption Avenue address, 30, 2nd left, the municipality of Santa Cruz de Tenerife, by D. Cristino Suárez López de Vergara, dated December 12, 2006, accompanied part of the mandatory documents. After receiving the request for relief by the owner as of December 26, 2006, provides new documentation dated January 5, 2007. 3 . - Inspected dated January 17, 2007 (Act No. 011/07TF and documentation accompanying chart), which notes that a) the treatment room has no sink, b) the owner states that the query is running from on November 1, 2006 in the latter location, c) the graph obtained documentation with permission of the owner and consisting of 29 photographs taken in the act of inspection, evidence of the existence of: liposuctores, surgical instruments, electrosurgery, local anesthetics and sterilizer Dry heat, corresponding to an offer proper equipment care classified as U. 64 Outpatient Minor Surgery, and d) barriers to access and evacuation center. 4 . - The study of memory and the inspection follows a contradiction between the requested activity and staffing capacity, which corresponds to an activity currently categorized as assistance U. 64 Minor Surgery Unit Ambulatory care (Annex II of Royal Decree 1277 / 2003 of 10 October [BOE No 254 of October 23] by establishing the general rules on licensing of facilities, services and establishments). The said activity has not been requested or cleared by the owner, nor for which lacks the requirements of the Directorate of the Canary Islands Health Service Accreditation Proposal and Authorization and collected in the "Minor Surgery Ambulatory U. 64: Technical criteria for performing minimally invasive procedures and examinations. " Under this, the Directorate of Health Canario ordering the temporary suspension of activity, by Resolution No. 110/TF, dated January 24, 2007, notified on 30 March. 5 . - For the owner is not cured (or in answer to the request, or as arguments to the inspection report or as a remedy of appeal to the Resolution ordering the temporary suspension of activity) the requirement section consisting of "existence in each of the areas of exploration . . lavatory porcelain or stainless steel, equipped with running water, liquid soap dispenser and disposable paper towels. " Nor do they contradict or argue the case indicative of the practice of activity corresponding to the Minor Surgery Unit Ambulatory care U. 64. I. - In accordance with Article 60. 1 of Law 11/1994 of 26 July, Health Planning de Canarias (BOC No. 96, 05/08/94), 9. 2. c) of Decree 32/1995 of 24 February, approving the Regulation on Organization and Functioning of the Canary Islands Health Service (BOC No. 32, 03. 15. 95) and 5. 2a) of Decree 225/1997 of 18 September (BOCNo. 129 of October 6), which regulates the installation and operation permits, centers, services, facilities and health activities, has jurisdiction to the Director of Health of the Canary Islands. II . - The conduct of the proceedings conform to the general rules on licensing of facilities, services and institutions, established by Royal Decree 1. 277/2003 of October 10 (BOE n º 254 of 23 October), nature and specific provisions in Decree 225/1997 of 18 September, which regulates the installation and operating permits for facilities, services, facilities and health activities (BOC No. 129 of October 6). III . - 1. 277/2003 Royal Decree of October 10, which establishes the general basis for the authorization of facilities, services and establishments (BOE n º 254, 23/10/03), subject to request permission to change health centers, services and facilities that make changes to its structure, ownership or in healthcare provision (Art. . 3. 2), is meant extensively to transfer authorization (not to be specifically provided). The authorization is granted after verification of compliance with the requirements for proper execution of their duties. In its Article 3. 2 states that the operating licenses and amendments shall be granted by the health authorities of the autonomous communities after verifying that the centers, health services and facilities meet the requirements for proper execution of their duties and Article 4. 2 that the minimum requirements may be supplemented in each Autonomous Community for the health administration for the centers, services and establishments within their scope. Among these is the case of applying the "existence in each of the areas of exploration . . lavatory porcelain or stainless steel, equipped with running water, liquid soap dispenser and disposable paper towels. "IV . - Royal Decree 1. 277/2003 defines, in Annex II, paragraph U. 64 minor outpatient surgery and care unit where, under the responsibility of a physician, diagnostic or therapeutic procedures performed with low complexity and minimally invasive low risk of bleeding, which is done under local anesthesia and not requiring postoperative care in patients not requiring admission. Regarding the Minor Surgery Outpatient Service Authorization and Accreditation has developed the "Ambulatory Surgery Minor U. 64: Technical criteria for performing minimally invasive procedures and examinations" to which sites to include in its offer care that health care activity. It is not disputed in this case compliance with these requirements. First . - The application for an operating license for transfer of medical consultation (U. 46 Plastic and Reconstructive Surgery) (health care providers without imprisonment), located at Avenida Assumption, 30, 2nd left, the municipality of Santa Cruz Tenerife, owned by D. Cristino Suárez López de Vergara. Second . - notice of this resolution to D. Cristino Suárez López de Vergara, meaning it does not end the administrative and can be challenged by appeal to the Minister of Health, within one month from the day following the practice of notification. . . .
